Section 1021P(5) of the Corporations Act 2001 (Cth) is Offences Relating to Offers to Which Division 5A Applies and reads as follows:

Offences Relating to Offers to Which Division 5A Applies

Failure to comply with other requirements of section 1019I

(5)  A person commits an offence if:
(a)  the person makes an offer; and
(b)  the offer is an offer to which Division 5A applies (see section 1019D); and
(c)  the person gives the offeree an offer document; and
(d)  either:
(i)  the offer document does not comply with subsection 1019I(1), or paragraph 1019I(2)(d), (e) or (f); or
(ii)  material of a kind referred to in subsection 1019I(1), or paragraph 1019I(2)(d), (e) or (f), that is included in the offer document is misleading or deceptive.

The penalties                                                                         

The maximum penalty for the offence of Offences Relating to Offers to Which Division 5A Applies is:

50 penalty units (a Commonwealth penalty unit is currently $210).

However, it should be kept in mind that maximum penalties are reserved for the most serious cases.
