The maximum penalty for the offence of “resisting arrest or hindering police” is 12 months in prison.

According to the Judicial Commission of NSW, the actual penalties imposed for the offence are as follows:

  • Community Correction Order: 22.6%
  • Conditional Release Order without Conviction: 18.2%
  • Conditional Release Order with Conviction: 10.2%
  • Prison: 4.4%
  • Section 10A No Other Penalty: 3.1%
  • Section 10(1)(a) Dismissal: 3%
  • Intensive Correction Order: 1.3%

The average prison sentence for the offence is 4 months imprisonment, and the average non-parole period (or minimum prison term that must be served) is 4 months in prison.
