Bribing a Commonwealth Public Official is an offence under Section 141.1(1) of the Criminal Code Act 1995 (Cth) which carries a maximum penalty of 10 years in prison and/or 10,000 penalty units for an individual or if the responsible entity is a company, the greatest of:
100,000 penalty units, or triple the ascertainable benefit gained, or 10% of annual turnover.
To establish the offence, the prosecution must prove beyond reasonable doubt that:
- You provided or caused to be provided a benefit to another person, or offered or promised, or caused such an offer or promise to be made,
- You did so dishonestly,
- The other person was a Commonwealth public official, and,
- You intended by your conduct to influence the official in his or her duties as a Commonwealth public official.
It is not necessary for the prosecution to prove that you knew the other person was a Commonwealth public official or that the duties you intended to influence were those of a Commonwealth public official.
Duress, necessity and self-defence are legal defences to the charge.
Receiving a Bribe as a Commonwealth Public Official is an offence under Section 141.1(3) of the Criminal Code Act 1995 (Cth) which carries a maximum penalty of 10 years in prison and/or 10,000 penalty units for an individual or if the responsible entity is a company, the greatest of: 100,000 penalty units, or triple the ascertainable benefit gained, or 10% of annual turnover.
To establish the offence, the prosecution must prove beyond reasonable doubt that:
- You were a Commonwealth Public Official,
- You asked for or received a benefit for yourself or another person, or you agreed to receive or obtain a benefit for yourself or another person, and
- You did so intending:
- that the exercise of your official duties would be influenced, or
- to induce, foster or sustain a belief that your official duties would be influenced.
