Part 3, subdivision 2 of the Australian Securities and Investments Commission Act 2001 contains provisions relating to the examination of persons, including notices under section 19 of the Act requiring persons whom the ASIC suspects or believes on reasonable grounds can give evidence relevant to a matter under investigation to attend for, and assist with, an examination on oath, the conduct of proceedings at the examination, the requirements therein including reporting, and the right to a lawyer.

The subdivision also makes clear that a failure to comply with a requirement can amount to an offence under section 63 of the Act, which prescribes a maximum penalty of 2 years in prison.
