Section 117(5) of the Corporations Act 2001 (Cth) is Applying for Registration – Consents and Agreements and reads as follows:

Lodging application

(5) An applicant must have the consents and agreements referred to in subsection (2) when the application is lodged. After the company is registered the applicant must give the consents and agreements to the company. The company must keep the consents and agreements.

The penalties

The maximum penalty for the offence of Applying for Registration – Consents and Agreements is:

30 penalty units (a Commonwealth penalty unit is currently $210).

However, it should be kept in mind that maximum penalties are reserved for the most serious cases.
