Attempts to Commit Offences under the Crimes Act 1900 are covered by section 344A of that Act, which states that a person who attempts to commit a Crimes Act offence is liable to the same penalty as if they had committed the offence.

The section further states that a person convicted of attempting to commit a ‘serious indictable offence’ is deemed to have been convicted of committing such an offence.

A ‘serious indictable offence’ is one that carries a maximum penalty of at least 5 years in prison.
