Self-Defence Excessive Force that Inflicts Death

Section 421 of the Crimes Act 1900 (NSW) is commonly known as the provision relating to excessive self-defence.

It makes clear that in cases involving force that inflicts death a person is not guilty of murder but instead guilty of manslaughter, if the person believed his or her conduct was necessary to defend himself or herself, or another person or to prevent or terminate the unlawful deprivation of his or her liberty, or that of another person but the force was not a reasonable response, in the circumstances as he or she perceived them.
