Making off without payment to a Commonwealth entity Is an offence under section 132.6 of the Criminal Code Act 1995 (Cth) which carries a maximum penalty of 2 years in prison.

To establish the offence, the prosecution must prove beyond reasonable doubt that:

  1. Immediate payment was required from you for goods or services,
  2. The goods or services were supplied to you by a Commonwealth entity,
  3. You knew the payment was immediately due,
  4. You made off without paying and thereby to avoid payment, and
  5. You did so dishonestly.

‘Immediate payment’ includes payment at the time of collecting goods in respect of which a service has been provided.

A ‘Commonwealth entity’ is any agency, department, office or other organisation or body created under Commonwealth legislation.

Whether your conduct was ‘dishonest’ is a matter of fact and is determined according to the standards of ordinary persons and known by you to be dishonest according to those standards.

Your conduct may be dishonest even if you were willing to pay at a later date.

A legal defence to the charge is ‘claim of right’ which is where you genuinely but mistakenly believed that you had a legal right to the whole of goods received without having to pay for them.

Duress is also a defence.

The Legislation

132.6  Making off without payment

(1)  A person is guilty of an offence if:

(a)  the person, knowing that immediate payment for any goods or services supplied by another person is required or expected from him or her, dishonestly makes off:

(i)  without having paid; and

(ii)  with intent to avoid payment of the amount due; and

(b)  the other person is a Commonwealth entity.

Penalty:  Imprisonment for 2 years.

(2)  Absolute liability applies to the paragraph (1)(b) element of the offence.

(3)  For the purposes of this section, immediate payment includes payment at the time of collecting goods in respect of which a service has been provided.
