Penrith Court
Penrith courthouse is located at 64 – 74 Henry Street in Penrith. The courthouse contains both Local Courts and District Courts.
The Local Courts have jurisdiction (power) to hear and finalise many less-serious criminal and traffic cases, as well as to deal with the early stages of even the most serious types of cases before referring them to a higher court, such as the District or Supreme Court.
Proceedings that come before the Local Court include bail applications, guilty pleas, driver licence appeals, committal proceedings (which are hearings to decide whether there’s enough evidence for a case to be referred to a higher court) and defended hearings – where a person pleads not guilty, witnesses later attend court to be questioned and the magistrate decides whether the prosecution has proven its case.
The District Court has the jurisdiction to hear a wide range of criminal and traffic cases, and is where appeals from the Local Court take place, such as appeals against the severity of sentence and appeals against conviction.
It is also where jury trials in more serious types of cases occur, as well as sentencing hearings in serious cases where a person wishes to plead guilty.
