The DPP has dropped all sexual assault charges against our 28 year old client from Auburn after the analysis of his phone and digital camera proved that the complainant was lying.
The 18 year old female complainant gave a statement to police alleging that our client sexually assaulted her in a carpark at Auburn, Sydney leading to her pregnancy.
She claimed to have never been in an intimate relationship with our client and that he lured her into his car, drove her to the carpark and had sexual intercourse without her consent.
Our client disputed the allegations, stating that the pair had been in a consensual sexual relationship for over 3 months before the alleged incident and that he never sexually assaulted her.
He had not informed his wife or friends about the relationship.
We asked whether there had been any photos or telephone communications that might prove the relationship.
He advised that all text messages and photos had been deleted.
Our team promptly arranged for forensic examination of his seized mobile phone and his digital camera.
That analysis produced abundant evidence that the complainant was lying.
We also took video footage of the subject carpark which turned out to be surrounded by apartment blocks.
That footage made it clear that any alleged incident would likely have been observed by residents.
The police photos had conveniently left-out those unit blocks.
Intense negotiations led to the withdrawal of all charges despite the complainant attempting to change her story in two further statements.
